The agreement governing your access to and use of the Aetheriks platform.
Eligibility — please read carefully. These services are not available to residents of New Zealand. By accessing or using the platform, you represent and warrant that you are an eligible non-resident client — an offshore high-net-worth individual or corporation — and that you meet our eligibility and verification criteria. If you do not meet these criteria, you must not use the platform.
These Terms of Service ("Terms") form a legally binding agreement between you and Aetheriks International Bank ("Aetheriks", "we", "our") governing your access to and use of our website, applications, and services. By accessing the platform or applying for an account, you agree to these Terms, our Privacy Policy, and our Risk Disclosures.
You represent and warrant that you are not a resident of New Zealand and that you qualify as an offshore high-net-worth individual or a corporation eligible to use our services. We may require evidence of eligibility and may decline any application in our sole discretion. Certain products are available only to professional, qualified, accredited, or institutional clients.
To use the services you must open an account and complete our identity and eligibility verification. You agree to provide accurate, complete, and current information and to update it promptly. We may suspend or terminate accounts where verification cannot be completed or where we are required to do so by law.
Subject to these Terms and applicable eligibility, we provide multi-currency accounts, payments and transfers, virtual and physical debit and credit cards, and digital-asset and tokenisation services. Banking, custody, and settlement functions are provided by or with regulated partner institutions. Specific terms may apply to individual products.
Fees, where applicable, are set out in the applicable product or pricing schedule and may change from time to time. You authorise us to debit fees and charges from your account.
You must not use the platform for money laundering, terrorist financing, fraud, sanctions evasion, or any unlawful activity; for transactions involving sanctioned persons, entities, or jurisdictions; or in any manner that could impair the integrity or security of the platform.
You are responsible for maintaining the security of your account credentials and two-factor authentication. We are not liable for losses arising from your failure to protect your credentials or devices, except as required by applicable law.
We may suspend or terminate your access at any time with or without notice where we reasonably believe it is necessary for security, compliance, or legal reasons, or where you breach these Terms.
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or special losses, or for losses arising from market conditions or events outside our reasonable control. Nothing in these Terms limits liability that cannot be excluded by law.
The platform and its content are owned by or licensed to Aetheriks. You may not reproduce, distribute, or create derivative works from them without our prior written consent.
These Terms are governed by the laws of the jurisdiction identified in your client agreement, or otherwise the laws of New Zealand (without regard to conflicts-of-law principles). Disputes will be resolved in the agreed forum or, failing agreement, through binding arbitration or the courts of competent jurisdiction as provided in your client agreement.
We may amend these Terms from time to time. Material changes will be notified in advance as required by law. Continued use after the effective date of changes constitutes acceptance.
